WHY USE AN ATTORNEY?

Having an attorney represent you for the telephone appeal has several distinct advantages:

Attorney representation need not be expensive. The Hearings Officer will try to limit the hearing to an hour or so.For that reason, we don't prepare like we would for a jury trial.Since the hearing is conducted as a conference call, neither you or your attorney need to travel for the hearing. For preparation and for the hearing itself my total fee is $500 or less, depending on the specifics of your case.

Cross examination skill makes the difference. Generally, the best way to prevail at the hearing is to get the employer to give or admit to informationn that supports your position. Most people are so wrapped up in telling their side of the story that they neglect to effectively cross examine the employer. An attorney is trained in that skill and uses it daily. It makes all the difference in the world.

Time management. With limited time to respond to the employer's case and to make your case , it is critical that you stay on message, emphasizing the points which support your case from the perspective of the Employment Security Commission's rules and guidelines. An attorney knows what the hearings officer is looking for and will likely be far better able to present it effectively within the time frame allotted. Experience matters.
